Terms of Service

Version 1.1 · Effective date: 2026-10-06

Agreement

These Terms of Service (the “Terms”) are a contract between you and Availdar Limited (“Availdar”, “we”, “us”). They govern your use of the Availdar apps (iOS / Android), website, and related backend services (the “Service”).

By creating an account you agree to these Terms. Please also read our Privacy Policy at https://availdar.com/privacy-policy, which explains how we handle personal data. If you do not agree, do not create an account or use the Service.

The official text of these Terms is English.

Eligibility

You must be at least 16 years old to register. You confirm this when you create an account (Apple, Google, or email). We do not independently verify age. If we believe an account belongs to a person under 16, we may suspend or delete it.

Accounts

You may sign in with Apple, Google, or email and password. You must provide accurate account information and keep your credentials and devices secure. You may optionally enable multi-factor authentication. The Service includes a device-session limit. You may suspend or delete your account in the app. Deletion usually includes an approximately 30-day cooling period, as described in the Privacy Policy and in the app.

You are responsible for activity under your account, except where the law provides otherwise or where unauthorised access occurs outside our reasonable control.

Licence

The Service, including the apps, website, software, design, and the Availdar name, is owned by Availdar Limited or its licensors. We grant you a limited, personal, revocable, non-exclusive, non-transferable licence to use the Service in line with these Terms. You may not copy, modify, reverse engineer (except where the law allows), or use our name or marks without permission.

Your content

You keep your rights in content you create in the Service (for example projects, availability, nicknames, notes, links, and labels). You grant Availdar a licence to host, store, back up, transmit, display, and delete or disable that content as needed to operate the Service, to show it to people you collaborate with or to whom you give a share link, and to comply with law.

You must have the right to provide that content. You are responsible for it, for any file you export, and for how other people use what you choose to share. We may remove or disable content that we reasonably believe breaches these Terms or the law. We are not obliged to monitor content.

Collaboration and Direct write

Share links, open join, find-by-account-code, and Direct write may let other people see or interact according to your settings. A share link is a key. Share only with people you trust.

In the app, “Direct write” / “add to schedule” means writing into Availdar calendar data, not into the Apple or Google Calendar apps on the device. If you revoke permission, we stop new writes. Entries already written may remain until the other person deletes them.

What Availdar is

Availdar is an availability and schedule coordination tool. It is not employment, HR, legal, tax, or other professional advice. Arranged times do not guarantee real-world attendance or any business result.

Acceptable use

You agree not to:

  • use the Service for unlawful, fraudulent, harassing, or rights-infringing purposes

  • spam notifications, mass-invite in abusive ways, or otherwise disrupt the Service

  • scrape, probe, or bypass technical limits or security controls without authorisation

  • upload malware or illegal content

  • impersonate others, or misuse names, account codes, or share links

We may limit features, or suspend or terminate accounts, where we reasonably suspect a violation.

Paid features

Paid plans can be bought in the iOS or Android apps, or on the website at https://app.availdar.com.

In the apps, purchases go through the Apple App Store and/or Google Play. Prices and plan details are as shown in the store at the time. Billing, renewal, cancellation, and refunds follow that store’s terms. To cancel or change a store-managed subscription, use that store’s subscription settings. Managing or restoring a purchase may require you to use the same store account that made the purchase.

On the website, purchases go through Stripe. Prices and plan details are as shown at checkout. A subscription renews automatically for the same period (month or year) until you cancel. You can update the payment method, change plan, or cancel in the billing portal opened from the website. A move to a higher plan may be charged immediately on a prorated basis. A move to a lower plan, or a cancellation, generally takes effect at the end of the period you have already paid for, and the current plan stays in place until then. We do not receive or store your full card number.

Deleting your Availdar account does not by itself cancel a website subscription. Cancel it in the billing portal, or charges may continue. If that account already has an active App Store or Google Play subscription, website checkout for a paid plan is not offered.

Refunds for app-store purchases follow that store’s rules. For a website subscription, email support@availdar.com. We do not promise a refund except where Hong Kong law requires one.

Third-party services

The Service depends on third parties (including hosting, push delivery, sign-in providers, payment processors, and crash diagnostics). Outages or changes by those parties are outside our reasonable control and do not, by themselves, constitute a breach by us.

Disclaimers

The Service is provided “as is” and “as available”. We may change, suspend, or discontinue features. To the maximum extent permitted by law, we do not promise uninterrupted operation, freedom from errors, or that third-party services will always be available. Nothing in these Terms excludes a right that cannot be excluded under Hong Kong law.

Limitation of liability

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that Hong Kong law does not allow to be excluded or limited.

Subject to that paragraph, to the maximum extent permitted by law:

  • Availdar Limited is not liable for indirect, incidental, special, or consequential loss, or loss of profits, data, or goodwill, even if we were told it might happen;

  • Availdar Limited is not liable for other people’s use of content you chose to share, or for a roster or other file after it has been downloaded to a device; and

  • our total aggregate liability arising out of or in connection with the Service, whether in contract, tort (including negligence), or otherwise, is limited to the amount you paid us for paid features in the 12 months before the claim, including amounts paid through the Apple App Store, Google Play, or Stripe and attributable to us. If you have not paid for paid features in that period, that aggregate limit is zero, except where Hong Kong law requires otherwise.

Suspension and deletion

You may stop using the Service at any time and delete your account in the app. We may suspend or terminate access for breach of these Terms, abuse, legal requirements, or to protect the Service or other people.

After the deletion cooling period, we remove account-bound data as described in the Privacy Policy. That includes projects you host and your availability on other people’s projects. Other people can no longer use a project you hosted. They may still keep past arranged times on their own home calendar and stats until they remove those records. Backups and security logs may remain for a limited time.

Licence, your content, acceptable use, disclaimers, limitation of liability, and governing law survive termination.

Changes

We may update these Terms. Material changes will have a new version and effective date, with reasonable notice in the app or on the website. If you do not agree, stop using the Service and delete your account. Continued use after the effective date means you accept the updated Terms, except where the law provides otherwise.

Other terms

If a provision is invalid, the rest remains in effect. A failure to enforce a provision is not a waiver.

These Terms are the entire agreement between you and us about the Service.

Governing law

These Terms are governed by the laws of the Hong Kong Special Administrative Region. The courts of Hong Kong have exclusive jurisdiction, except that we may seek injunctive relief elsewhere to protect the Service or our intellectual property.
